DEP Site Remediation Reform Act (SRRA) Extensions

Governor Christie signed Assembly Bill A-4543, allowing DEP to grant two year extensions for the completion of certain remedial investigations under the Site Remediation Reform Act (SRRA), which previously required that any site at which a remediation obligation arose on or before May 7, 1999, and for which a remedial investigation had not been submitted to DEP by May 7, 2014, would be become subject to direct DEP oversight. Direct oversight deprives responsible parties of the ability to make decisions regarding how a property is cleaned up, and requires the establishment of a funding source equal to the projected cost of cleanup. It is, therefore, something to be avoided. The newly enacted law extends the May 7, 2014 deadline to May 7, 2016, provided that any responsible party who wishes to qualify for an extension submits an application to DEP on or before March 7, 2014.
